PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE SITE. By using lagabiere.com, you acknowledge having read and understood these conditions. If you do not want to be bound by these terms and conditions, you may not use or order products through lagabiere.com. Transactions on the site lagabiere.com reserves the right to refuse any order placed on lagabiere.com. At our sole discretion, it is possible to limit or cancel the quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card and/or orders with the same billing and/or shipping address. In the event that we make a change to an order or cancel it, we will contact you by email and/or at the billing address or telephone number provided at the time the order was made. Orders placed on the lagabiere.com website are normally processed within 48 working hours. Payment: Orders placed on the lagabiere.com website must be paid by credit card. We accept VISA and MASTERCARD, AMEX and Diners only. Price: The prices displayed on the lagabiere.com website are in Canadian dollars, before taxes and the Recyc QC deposit fee. The price is payable in full and in a single payment at the time of ordering. All orders are payable in Canadian dollars. Prices on the lagabiere.com site may vary from prices at the Lagabière boutique at 537 3e Rang, Saint-Jean-sur-Richelieu, QC J2X 5T5. Taxes: Sales taxes charged comply with the taxes required by the province of Quebec - GST + QST. To cancel or modify a current order, please email us - info@lagabiere.com or call customer service at T: 450.376.6343. Order error: No returns can be made on errors made on your part after picking up the order. It is your responsibility to verify orders at the time of pickup. Promotions: Promotions on the lagabiere.com site may be governed by terms that differ from these terms of sale. Promotions may be modified or withdrawn at any time, without notice.Dispute Resolution: Given the high cost of litigation, not only in dollars but also in time and energy, Lagabière - Brasserie Artisanale. and you agree to the following dispute resolution procedure: Except to the extent prohibited by applicable law, in the event of any dispute, claim, action or difference arising out of or relating to a transaction conducted on lagabiere.com, or violation, enforcement, interpretation or validity of this Agreement or any part thereof (“Dispute”), the party asserting the Dispute must first attempt to resolve it in good faith by sending a written notice to the other party (by special or registered mail), describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the recipient thirty (30) days to respond or resolve the Dispute. A notice must be sent to: (1) Lagabière - Brasserie Artisanale - 537 3e Rang, Saint-Jean-sur-Richelieu, QC J2X 5T5; (2) to you: to your last billing address or the billing and/or shipping address listed on your online profile. To the extent permitted by law, you and Lagabière - Brasserie Artisanale agree that this dispute resolution procedure is a prerequisite that must be met before initiating any litigation procedure or filing an appeal against the other party. Legislation and jurisdiction To the extent permitted by law, this Agreement shall be interpreted in accordance with the laws applicable in Quebec and Canada, without regard to conflict of law provisions. General: The waiver of a provision of the Contract shall not be considered as a waiver of any other provision or of the right of Lagabière - Brasserie Artisanale to require strict compliance with each of the conditions herein. If any provision of the Agreement is found to be unenforceable or invalid for any reason, that provision will be severable and all other provisions will remain in effect. This Agreement constitutes the indivisible contract between Lagabière - Brasserie Artisanale and you regarding your use of the site. Lagabière - Brasserie Artisanale may assign its rights and obligations under this Contract. The Contract will be applied for the benefit of the successors, assigns and authorized persons of Lagabière - Brasserie Artisanale. Termination: These terms are effective until terminated.
